FORMAT OF BAIL APPLICATION IN NON-BAILABLE CASE (Section 437 OF CODE OF CRIMINAL PROCEDURE)

Section 437 of CrPC states about the conditions when any person accused of or suspected of, the commission of any non- bailable offence is arrested or detained without warrant by an officer in charge of a police station or appears or is brought before a Court other than the High Court or Court of Session, he may be released on bail.

MOST RESPECTFULLY SHOWETH: –

  1. That the present FIR has been registered on false and spurious facts. The facts stated in the FIR are fabricated, fictitious and with no any basis.
  2.  That the applicant/accused has no connection with the offence levied against him.
  3.  That the applicant/accused is an innocent man and has respect in the society, that his long custody in the jail will blemish his future career and esteem in the society.
  4. That the applicant/accused has good antecedents and belongs to a reputable family.
  5. That the accused/applicant is a permanent resident and there is no chance of his escaping from justice.
  6. That there is no criminal case pending against him excluding the present one.
  7. That the applicant/accused without prejudice his right is ready to deposit the amount in question before this Hon’ble Court till the final disposal of the case.
  8. That the applicant/accused undertakes to present himself before the police/court on every date of hearing as and when directed if he is enlarged on bail by this Hon’ble court.
